Sales Terms and Payment Terms
IMPORTANT NOTICE: PLEASE READ THIS DOCUMENT, THE SALES TERMS AND PAYMENT TERMS (the “Terms”), CAREFULLY AS IT CONTAINS IMPORTANT INFORMATION REGARDING THE USER’S LEGAL AND CONTRACTUAL RIGHTS AND OBLIGATIONS. THIS DOCUMENT INCLUDES PROVISIONS SUCH AS REMEDIES IN DISPUTES, GOVERNING LAW, AND JURISDICTION LIMITATIONS. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT COMPLETE ANY PURCHASE.
SteerMeUp aims to protect users’ interests by tracking order and appointment information, payment information, and product/service updates related to the purchase and sale of services between users, and by reducing any harm that may arise from violations of the Rules. Payment transactions between users are carried out through third-party applications/providers.
All purchases made through SteerMeUp, its affiliates, or third-party applications, and the fees and payment policies to be applied within SteerMeUp services (the “Services”) are subject to these Terms. Any user (the “User”) who performs any purchase/payment transaction— including payments related to Services or content, sending gifts, and ancillary products and services— is deemed to have read, understood, and agreed to be bound by these Terms and by the User Agreement and Terms of Service, which form an integral part hereof. This consent also covers the provisions on Indemnity, Disclaimer of Liability, Disclaimer of Warranties, Limitation of Liability, and Governing Law and Jurisdiction.
1) Amendments to the Terms
SteerMeUp may amend any provision of these Terms by publishing the amendment and updating the “Last Updated” date. Amendments are announced within a reasonable time in advance and become effective for purchases/subscriptions and renewals occurring after the stated effective date. Where deemed necessary, SteerMeUp may request explicit confirmation of the changes. Users are expected to check for amendments at regular intervals.
2) Purchase Conditions and Account Security
Purchases/payment transactions within the Services may only be made by registered users. The User is responsible for the security of the account and for preventing unauthorized access, and accepts that all transactions on the account will be deemed to have been carried out by the User. Services can be purchased only with Payment Methods accepted by SteerMeUp and described below.
Users who are not of legal age in their country may not accept these Terms without the consent of a parent/guardian/legal advisor. If a transaction is made contrary to this prohibition, it is presumed that the necessary consents have been obtained. SteerMeUp reserves the right, in its sole discretion, to reject/cancel orders or close accounts.
3) Sale of Services and Digital Products
The Services offered by SteerMeUp consist of video/audio calls between users; various physical or digital products; interactive materials usable based on call quality/duration; recording and other ancillary products and services; interactive content and applications provided by users or third-party developers; and other products/services/privileges to be offered in the future.
The payment transaction is subject to the terms in effect at the time of approval. SteerMeUp may make digital products acquired/purchased available only within certain Services and may prohibit their use in third-party services. The User accepts that prices may change for any reason.
The use of any Service/digital product is subject to the Terms of Service and these Terms. SteerMeUp provides infrastructure among users; it does not give any undertaking regarding the performance, continuity, or results of the calls/services that users provide to one another, and is not responsible for such services.
SteerMeUp may cancel transactions that violate these Terms; in the presence or suspicion of unlawful acts, it may share payment information with competent authorities or third parties it believes to be connected to the violation. The User agrees to indemnify SteerMeUp for any losses and claims arising from payments the User has authorized/accepted.
SteerMeUp does not guarantee that products/services offered by users/third-party developers will be offered continuously, or that publishers will keep their content active for specific periods. Products/services/fees may change. SteerMeUp may, at its sole discretion, change its policies and prices, and may suspend or remove content/broadcasts that violate the Terms of Service and Community Guidelines.
Unless required by applicable law, unused SMUCoins and all digital products acquired by users shall be transferred to SteerMeUp upon termination of the account. Any user may be disabled for any reason; in such case, accumulated items become invalid and may not be re-enabled.
If SteerMeUp terminates a Service or digital product, it may allow a reasonable period of use from the date of the termination announcement; on the termination date, unused items become invalid and no compensation shall be paid.
4) Changes, Notices, and Errors in the Services
SteerMeUp endeavors to provide accurate information about products/services and to correct errors; however, it does not guarantee that descriptions, images, pricing, or other information will always be complete/accurate/current/error-free. SteerMeUp and its partners may continuously update the Services to offer new Ancillary Products/Services. SteerMeUp may make changes without prior notice, discontinue offerings, or replace them with new ones. If an ordered product/service is changed, SteerMeUp may cancel the order, replace it with a product/service of equal or greater value, or provide equivalent SMUCoin credit.
5) Warranty for Products/Services and Digital Content
No express or implied warranties are provided regarding any product/service or digital content offered by SteerMeUp. In the event of defects/deficiencies, implied warranties/undertakings are disclaimed to the maximum extent permitted by applicable law and the User Agreement.
6) Taxes
For purchases of products/services/digital content, all VAT, SCT, fees and charges, remittance/EFT/card commissions, and similar taxes/fees are the responsibility of the user. Taxes related to gifts/donations are calculated based on the user’s country of residence. All fees and tax liabilities arising from the user’s failure to pay are the user’s responsibility. SteerMeUp reserves the right to collect such taxes/fees it incurs from the relevant user.
7) Pricing Authority
SteerMeUp may allow certain broadcasts/publishers to price above the suggested tariff, for example due to production costs or demand. Different fees may be applied to some user groups based on location, payment method, number of views, or for promotion/campaign/reward reasons.
SteerMeUp may implement local pricing programs. For this purpose, it assesses eligibility using information such as IP address, payment method location, declared address, unusual transaction volume as an indicator of fraud, and similar information; in suspicious cases, it may refrain from applying the tariff for the declared location. Users accept that they will not fraudulently benefit from pricing programs by making false residency declarations via VPN/Proxy/TOR or similar methods.
SteerMeUp may, for promotion/campaign purposes or to increase the number of viewers and support certain publishers, apply campaigns outside announced tariffs; request compliance from publishers; and temporarily/permanently limit or block access to broadcasts that do not comply.
8) Publisher and/or Third-Party Terms
Due to reasons arising from the publisher or the use of third-party products/services, additional terms may apply or differences may occur in practice. Users who purchase such products/services are deemed to accept these additional terms and to acknowledge that SteerMeUp bears no responsibility in this regard.
Since SteerMeUp offers all users the ability to start a broadcast at any time, every user is a potential publisher. Users who wish to earn income by broadcasting are deemed to accept the Publisher Agreement (Earning on SteerMeUp), which is an integral annex to these Terms.
9) Delivery of Services and Products
Products/services purchased through the Services must be provided to the ordering user within the scope and time permitted by the Terms of Service and applicable legislation. Delivery responsibility lies with the publisher user. In the event that the product/service/content cannot be used for any reason, SteerMeUp has no obligation to deliver/procure it. Nevertheless, disputes regarding undelivered products/services may be reviewed upon timely application by the purchasing user, and where deemed necessary, the fee payable to the publisher may be refunded to the purchaser.
10) Payment Methods and Conditions
Services may be used in exchange for SMUCoin. SMUCoin is digital content belonging to SteerMeUp and cannot be used outside the Services. A user who purchases SMUCoin is deemed to accept these Terms.
For SMUCoin purchases to be made via iOS and Android stores to which you will be directed through the application, additional costs such as taxes/shipping/remittance-EFT/bank/credit card commissions are reflected in the total amount; please check before payment. Additional fees may vary depending on third-party methods/platforms.
SMUCoins may be purchased using major credit cards, certain debit cards, and similar payment instruments that may be offered from time to time. Current card/bank information must be added to the account to purchase products/services. When an order is placed, it is accepted that the User is authorized to use the designated payment instrument; that SteerMeUp/the payment provider is authorized to collect the amount including all taxes and fees; and that, for transactions with another person’s card, the cardholder’s consent has been obtained. Unless otherwise specified, all payments are made in Turkish Lira. All in-service or third-party purchases are final; even if canceled, no refund is made (without prejudice to mandatory legal obligations).
SteerMeUp is not responsible for defects/deficiencies/delays in third-party payment services; however, it makes reasonable efforts to resolve problems reported to it.
The purchased SMUCoin balance becomes visible and usable on the user page when the third-party provider transfers the amount to SteerMeUp’s accounts. Documents related to in-service purchases are sent to the registered email address. The User accepts that the provided address/contact information is accurate and up-to-date.
Users may save a payment instrument for future purchases, including subscriptions. In that case, unless changed, it is used automatically for relevant transactions. Saving a payment instrument authorizes SteerMeUp (its affiliates/partners) to make small verification charges or automatic collections. SteerMeUp may update card information (expiration date, number, etc.) under payment network account updater programs and reflect such updates to saved details to prevent failed payments. Where necessary, SteerMeUp may request additional information such as government ID, legal name, date of birth, address, and may contact the user.
Transactions declined due to payment instrument issues may be suspended/canceled. Resolving the issue is the user’s responsibility; the user may contact Customer Support for assistance.
SteerMeUp may apply additional transaction fees related to transactions in the Services (including fees on third-party purchases). Such fees are disclosed to the user before completion.
11) User SMUCoin Credit
At registration, SteerMeUp may load 300 SMUCoins as credit to the user’s account. This credit may be used only within the application and cannot be converted to cash. Unused credit may be reclaimed if the account is suspended/closed or in other cases deemed necessary. It is not reclaimed from users who do not earn income from SteerMeUp services, in accordance with applicable legislation and the User Agreement. For users who earn income and have used the credit, an amount equal to the credit’s current value is offset by converting from their income into SMUCoin or by blocking the used SMUCoin. The blocked amount is not refunded and cannot be converted to cash. SteerMeUp may unilaterally change the credit amount and implementation principles.
12) SMUCoin Usage Policy and Guidelines
SMUCoin is digital content usable only within the Services and is not a value transfer instrument outside the application. SteerMeUp offers SMUCoins for in-app uses such as purchasing broadcasts and appreciation/donations. This policy applies to all publishers and viewers who purchase/acquire/use SMUCoins and may be updated from time to time.
SMUCoins cannot be directly exchanged by persons other than SteerMeUp for items/services with monetary value.
They cannot be used for items/services with monetary value outside SteerMeUp, and provide no return.
SteerMeUp may define goals, leaderboards, rewards, campaigns; and may allow SMUCoin activities.
Among users, buying/selling/donating/promising SMUCoins in exchange for money/monetary value or specific services is prohibited. Any such sale/transfer attempts are void.
Use/request/acceptance of SMUCoins for betting/gambling, fraud, or other unauthorized activities is prohibited.
All restrictions in the Terms of Service, Rules of Use, and Community Guidelines also apply to SMUCoin usage.
13) Earning SMUCoins by Watching Ads
From time to time, SteerMeUp may award SMUCoins in exchange for watching ads. Due to third-party ad inventory, etc., these opportunities may be limited; continuous or periodic availability is not guaranteed. Use of automation/robots is prohibited.
14) Earning Income from SteerMeUp Services
14.1) Broadcast Revenue
The Services offer the publisher the opportunity to earn income in exchange for one-to-one calls between users. SteerMeUp does not provide any income guarantee or commercial license to any user.
Users may conduct calls instantly or by appointment; determine fee categories based on broadcast/maintenance quality, duration, location, etc.; and add per-minute fees/package/promotion attributes. Except for SteerMeUp-defined promotional limits, paid broadcasts may not be set below the minimum broadcast fee and duration.
From SMUCoins earned from broadcasts, the service fee commission determined by SteerMeUp is deducted; the remaining SMUCoins are added to the publisher’s account. SteerMeUp may set and change maximum/minimum SMUCoin amounts per broadcast/minute.
14.2) Gifts and Messages
During calls, additional SMUCoins or Gift Emojis prepared by SteerMeUp may be sent to the publisher for thanks/congratulations/gifts or for message delivery. SMUCoins sent are added to the publisher’s account after deducting the service fee commission. SteerMeUp may limit and change the SMUCoin amounts that can be sent at once or within a given period.
15) Refund Policy
When users purchase broadcasts, they can access the broadcast and related ancillary products/services at the scheduled time. To the extent permitted by law, cancellations are not allowed after purchase and no refunds are made. Where deemed necessary, SteerMeUp may provide partial/full refunds or substitute benefits; the type and amount are determined solely by SteerMeUp. Such practices do not constitute acquired rights or precedent. The policy may be changed at any time.
Unless otherwise stated in these Terms or required by mandatory law, purchased broadcasts/digital products are non-returnable. Users experiencing issues must contact Customer Support promptly.
16) Payment of Publisher Revenues
To receive payments, the bank account information entered into the system must be in the publisher’s own name. The user account holder and the bank account holder must be the same person. If the registered first/last name does not match the bank account holder’s information, the user is asked to resolve the inconsistency; if not resolved, no payment is made, and maturity (due and payable status) cannot be claimed for delayed/unpaid amounts.
SteerMeUp makes payments on the conditions that there is no legal/contractual obstacle; payment and user information match; the user is over 18; and Services are not abused. Identity verification and additional procedures may be applied; where necessary, payment may be suspended, credit not assigned, and further use blocked.
17) Payment Policy
17.1) General Conditions
Receiving payment via SteerMeUp means the Community Guidelines, payment policies, and all provisions of these Terms have been read and accepted.
Transferring payments requires accurate/current/complete registration information as a precondition.
In cases of mismatched account/user information, user being under 18, incapacity, or abusive/unlawful use, SteerMeUp may stop/suspend/cancel payment, reclaim SMUCoins credited, and apply other measures.
The same powers apply where there is a legal/factual obstacle to using payment services or non-compliance with legislation/Terms/Community Guidelines.
SteerMeUp may unilaterally change payment terms without prior notice. Continued use after changes constitutes acceptance.
All monetary transactions are conducted via SMUCoin. The value of 1 SMUCoin is determined by SteerMeUp; the name and/or parity may be changed.
For payment security, additional identity verification and different procedures may be applied; identity/payment information and account activity may be shared with authorities and relevant third parties due to suspicion of illegality or mandatory provisions.
17.2) Special Conditions
Before payout, a service commission of thirty percent (30%) and VAT are deducted from user earnings. The commission is calculated based on the SMUCoin sales rate on the deduction date. Where SteerMeUp is the tax-responsible party, taxes to be deposited on behalf of the user are set aside.
After deducting the commission, any user debts, and statutory tax withholdings, the remaining net amount is deposited in Turkish Lira into the user’s designated bank account. The commission rate and application principles may be unilaterally changed by SteerMeUp; new rates/principles apply to income after the effective date.
SteerMeUp’s tax responsibility or tax withholding on behalf of users does not remove users’ filing/payment obligations. Users submit tax returns per their regime and pay taxes on time.
SMUCoin buy/sell prices may vary by payment method and platform (iOS/Android/virtual payment); exchange rate and deduction differences and third-party pricing may cause variations in user payments.
SteerMeUp cannot be held responsible for defects/deficiencies/delays in goods/services obtained from third parties; however, it makes reasonable efforts regarding reported issues.
User earnings are paid monthly, within no later than forty-five (45) days following each calendar month-end, and—unless otherwise specified by the payment service—in the national currency valid at the publisher’s residence. SteerMeUp may, depending on financial/operational conditions, change this period, release payments in tranches, hold amounts partially/fully as collateral, or generally change payment procedures and principles. General changes apply to income after the announcement/effective date.
In case of overpayment for any reason, SteerMeUp is authorized to claim the excess and/or collect its receivable by converting SMUCoins in the user’s account into cash.
18) Governing Law and Jurisdiction
These Terms and the use of the Services are subject to the applicable local law, without prejudice to mandatory provisions of law. Competent courts and enforcement offices shall have jurisdiction over disputes.
19) Limitation of Liability; Disclaimer of Warranties and Liability
SteerMeUp does not warrant that the Services will be uninterrupted/error-free. To the maximum extent permitted by law, SteerMeUp shall not be liable for indirect, incidental, special, or consequential damages, including loss of data or profit. Mandatory statutory provisions remain reserved.
20) Indemnity
The User agrees to indemnify SteerMeUp against all losses, costs, and claims (including reasonable attorneys’ fees) arising from violation of these Terms, the Terms of Service, or the User Agreement; unauthorized use; violation of applicable law; or infringement of third-party rights.
Final: These Terms are binding on all users who benefit from the Services. By continuing to use the Services, you are deemed to accept the Terms.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the revised policy on our app.
